Remember always that the definition of “worker” (in various pieces of legislation but mainly in Employment Rights Act 1996 s.230(3)) is not the same as the definition of “employee” (in s.230(1)) and that both definitions exclude a self-employed person in business on their own account.

A brief list of the main statutory employment rights available to both employees and workers includes:-

• anti-discrimination legislation (discrimination against part-time workers as well as sex, race etc discrimination);
• NMW rules;
• rules re protection of whistleblowers;
• most Working Time rules (max 48 hr working week, right to rest breaks and to holiday).

A brief list of the main statutory employment rights available to employees but not to workers includes:-

• unfair dismissal rights;
• redundancy rights;
• minimum notice rights;
• SMP; SPP;
• TUPE protection;
•  vicarious liability of employers.
